Terms & Conditions of Sale

Welcome to Pants People. Sales of our products to you are subject to the conditions set out below. Please read these conditions carefully before using the Pants People website www.pantspeople.com (“the website”). By using the website, you signify your agreement to be bound by these terms.

The website is hosted in England and has been built to comply with, and be governed by, English law. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.

Your statutory rights are not affected by these terms and conditions.

“You” or “you” is any user of the website.

1. Who We Are

2. Your Account

You are responsible for restricting access to your computer to prevent unauthorised access to your account, for maintaining the confidentiality of your account and your password. You agree to accept responsibility for all activities that occur under your account or password. You should inform us immediately if you believe that your password has been used without your authority, or if the password is likely to be used in an unauthorised manner.  It is your responsibility to take whatever steps are necessary to ensure that the password is kept confidential and secure.

The details that you provide us should be correct and complete and it is your responsibility to tell us about any changes to the information that you provided when you registered.

We do reserve the right to refuse access to the website, remove or edit content, terminate accounts, or cancel orders, entirely at our discretion. You will not be charged for any cancelled order.

It is possible to set up your own personalised account on the website which contains your e-mail address, order history and “Wish List” of products which you have personally selected and which you (and your friends if you have told them about the web address of your “Wish List”) may be interested in buying (for you) in the future. You will need your username or e-mail address together with your password to view or edit your account information.

3. Privacy

Your privacy is important to us. Pants People is committed to ensuring that your privacy is safeguarded at all times.

Our privacy policy sets out the procedures which we have in place to protect your privacy.

We explain below how we use the information you provide us with and how you have the right to instruct us to limit or stop the use of that information.

You may order from the website as a guest or create a new account on the website. In both cases, you will need to provide your full name, delivery information, billing information and e-mail address.

If, on the other hand, you solely wish to receive news about Pants People or its website (e.g. underwear news, blog alerts, offers or changes in functionality), you need to subscribe to the free Pants People newsletter by providing your e-mail address only.

Once you have created a new account, you will be able view your order history as well as update your username, e-mail address and password. You will also be able to subscribe to or unsubscribe to the Pants People newsletter and you will be able to view and update your “Wish List”. If you no longer wish to keep your account with Pants People, you can either remove it by clicking on the “Delete” button at the bottom of the “Edit” tab within “My Account” or you can send an e-mail here to notify us that you wish to have your account details removed from the system.

We take our privacy and security obligations seriously, as does our third party hosting company and third party payment processing company. We have rigorous internal checks to protect the storage and access of your information at all times.

We will never rent or sell your personal information without your express permission.

We abide by current data protection regulations under the Data Protection Act 1998 and ensure that any information we obtain will always be used, stored and transferred in accordance with all applicable data protection laws.

Your contact details, which are submitted by you when creating an account, or when subscribing to the newsletter, will enable us to advise you of any changes on the website including functionality.

You have the right at any time to opt-out of receiving direct marketing communications from us, by sending an e-mail here indicating that you do not wish your contact details to be used for the purpose of direct marketing in the future.

This service will be free of charge for the first time only. Any subsequent requests will be charged at £10.00 per request.

As an extra precaution, please remember to always logout from the website and close your browser window when finished.

NB: The internet is not a secure medium so we cannot guarantee the security of any personal information which you provide us with at your own risk.

4. Access to the Website

We will endeavour to ensure that uninterrupted access to the website is available at all times. Access may be temporarily or otherwise suspended without notice and may be due to circumstances beyond our control or due to repairs, website maintenance, implementation of new products, facilities, services or features. Wherever possible, we will attempt to limit the frequency and duration of any such suspension or restriction.

5. Licence for Website Access and Copyright

We grant you limited licence to access and make personal use of the website. All trade marks, copyrights and any intellectual property rights belong to, or are reserved by, Pants People or the organisations contributing the relevant material.

You may print, copy or cache extracts from the website for your own personal non-commercial use. No documents or graphics are to be used in isolation or to be modified in any way.

Otherwise no part of the website may be copied, reproduced, downloaded or otherwise transferred without the prior knowledge and express consent of Pants People.

You may not link to the website or frame it without obtaining our express permission. To link to the website, please contact us. You may not use any Pants People logo or other proprietary graphic or trademark as part of the link without our express written consent.

6. Trademarks

Pants People, its slogan “nuts about underwear” and other marks that may be indicated on our website are trademarks or registered trademarks in the European Union and/or other jurisdictions. Our graphics, logos, page headers, button icons, scripts and service names are the trademarks or trade dress of Pants People. Our trademarks and trade dress may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Pants People. All other trademarks not owned by us, but by third parties, that appear on this website are the property of their respective owners, who may or may not be affiliated with or connected to us.

7. Our Contract

You are seeking to enter into a contract with Pants People when you place an order. When you place an order to buy a product from our website, we will send you an e-mail which contains information on your order and confirms receipt of your order. Your order represents your offer to us to purchase a product and when we despatch that product to you, we accept your offer. We will confirm your order by e-mail. Our acceptance will be complete at the time we send the product(s) to you. Any products on the same order, which we have confirmed will be dispatched separately from the rest of your order do not form part of that contract.  
We reserve the right to cancel any order where full payment is not received.

8. Returns & Refunds

Our Returns & Refunds policy can be viewed here and it applies to all products purchased from us. In addition to our policy, customers in the European Union are entitled to a statutory cooling-off period of seven business days. Under the EU’s Distance Selling Regulations, you have the right to cancel the contract for the purchase within seven working days from receipt of your delivery, without giving a reason.

To cancel, you need to do so in writing. You will need to e-mail us, quote the order number and give us your clear instruction to cancel your order.

The above is subject to the product being returned unworn, unused and unwashed, in its original packaging and in a saleable condition (as new). You are responsible for the safe return of the product in its original condition and any costs of return.

We will refund the relevant part of the purchase price for the returned order as soon as possible, but in any case within 30 days after we receive your notification.

9. Pricing and Availability

In general, if a product, size or colour is unavailable, you will be unable to order it on the website. On rare occasions, it may appear that a product on the website is available when it is out of stock. This is due to the fact that certain products can sell out quickly and there may be a slight delay before this is reflected on the website. However depending on our restocking plans and availability, products may become available again. We will inform you by e-mail if any product you order is out of stock, and if appropriate, when it is likely to be back in stock.

Delivery estimates are merely estimates not guaranteed delivery times and must not be relied upon as such.

10. Customs

Overseas deliveries may be subject to import duties and taxes, levied once the package reaches its destination. You, the recipient, must bear any additional charges for customs clearance. Unfortunately, we have no control over these charges so you should contact the local customs office for further information. The recipient is considered the importer of record and must comply with all laws and regulations of the country in which the goods are received. Cross-border deliveries may be subject to opening and inspection by customs authorities.

11. Children

If you are under the age of 18, you may use our website only with the involvement of a parent or guardian. We do not sell any products for purchase by children.

12. Alteration of Service and Amendments to Our Terms and Conditions of Sale (“our terms”)

We reserve the right to make changes to our website, policies, and our terms at any time. You are subject to the policies and our terms in force at the time that you use the website or order goods from us (unless any change to the policies or our terms is required by law or government authority, in which case it will apply to orders already placed by you). If any of our terms is deemed invalid, void, or for any reason unenforceable, that term will be deemed severable and will not affect the validity and enforceability of the remaining terms.

13. Events beyond our reasonable control

We cannot be held responsible for any delay or failure to comply with our obligations under these terms if the delay or failure arises from any cause beyond our reasonable control. This does not affect your statutory rights, however.

14. No Waiver

In the event that we take no action against you where there is a breach of any of these terms by you, we reserve the right to make use of all available rights and remedies and any relinquishment or surrender in this respect does not constitute a waiver of our rights. We will still be entitled to use our rights and remedies in any other situation where you breach these terms.

15. Cookies

We use cookies as part of the mechanism to hold a reference to certain data on the server that holds the contents of the shopping cart, as well as other user-specific data including your username, and as such we require both permanent and session cookies to be enabled. There is no requirement to have third party cookies enabled for our website to work. If third party cookies are not accepted it does not affect the functionality of our website.

16. Opting in / out

We may from time to time offer you the opportunity to receive regular e-mails, offers or online vouchers. These opportunities are either opt-in or opt-out. Each opportunity will explicitly state whether it is opt-in or opt-out. If you have any queries about this you can contact us here.

18. Website Security

We strive to adhere to and to adopt industry standard practices in order to protect the confidentiality of your personal information on the website, including firewalls and Secure Sockets Layer (SSL) encryption software.

Your payment and order details are usually sent to us across a secure connection that uses a 128 bit certificate. Information is encrypted and cannot be read by anyone. Your payment goes to a secure third party payment processing company. For further information see paragraph 27 below - Payment Methods.

We cannot accept liability for any losses caused to you as a result of using a non-secure connection. Similarly, although the secure encryption we use is internationally regarded as secure, we cannot accept liability should such encryption be broken.

19. Pants People newsletter

If you wish, you can unsubscribe to the Pants People newsletter by visiting the “My Account” section on the website and clicking on “Manage my subscriptions”. You can then untick the box next to Pants People newsletter. You can also change your e-mail address in “My Account” as required.

20. Creating a New Account

You can create a new account by clicking the Login/Register link on the website and then selecting “Create new account”.

You will be asked to enter a username and e-mail address. Both a temporary password and one-time login link will then be sent to your e-mail address in one e-mail. You can either use the temporary password to login to the website or you can simply click on the one-time login link which will direct you back to “My Account” where you will be asked to change your password. You need your username or e-mail address together with your password to place orders on the site, see or edit your login details and track your orders online.

21.    Forgotten your Password?

If you forget your password, please click on “Login/Register” at the top of the homepage. Then click on “Request new password” in the pop-up window. You will be asked to enter your username or e-mail address. Both a temporary password and one-time login link will then be sent to your e-mail address in one e-mail. You can either use the temporary password to login to the website or you can simply click on the one-time login link which will direct you back to “My Account” where you will be asked to change your password.

22.    Changing your Account Details

You can access your account details by logging in to the website. Click on the “Login/Register” link at the top of the homepage and then enter your username and password. You can then change your username, e-mail address, password and your free subscription to the Pants People newsletter.

23.    Back orders

In certain cases, if we are out of stock on a particular product, size or colour but are expecting further deliveries from the designer brand, the website may still allow you to place an order for it, and if so, we will inform you when the new stock is likely to arrive.

The wait time for new stock is usually 2 - 3 weeks, but may sometimes be shorter or longer. If it is longer than 3 weeks, we will notify you at the time and offer you the option of either continuing to wait or cancelling your order.

Unfortunately, designer brands do sometimes discontinue lines with no advance warning. We cannot control this, but we will always let you know if we are unable to fulfil your order.

If part of your order is out of stock, we will split the items and ship what we can to you immediately - subject to your payment being processed of course.

We never take any payment from your card until the goods are ready to be dispatched.

You will also only be charged once for shipping and gift wrapping (if you have chosen the “Surprise Gift” option), regardless of whether we have to split your order. If you have selected “Surprise Gift” and your order has to be split, then all separate shipments will be gift wrapped too. We will however only send one gift card which will be shipped with the first part of the gift wrapped order.

24.    Delivery Information

We will ship your order as soon as we can, subject to payment authorisation and stock availability.

You will only be charged once per order for delivery and gift wrapping (if applicable) however many separate shipments we split your order into.

If you order before 2pm on Monday to Friday, then your order will be dispatched the same day. If your order is made after this time (or at any time during the weekend or on a UK public holiday) your goods will be dispatched the next working day.   

25.    Delivery Times

We strive to have your order delivered on time, but please allow for any adverse conditions which might affect deliveries from the UK to your area, including (but not limited to) extreme weather or disruption to postal services or airlines.

Our estimated delivery times are as follows:

United Kingdom

  • First Class Recorded – Delivery 1 – 3 working days
  • Express – Delivery next working day for orders placed before 2pm Monday - Friday


  • Airmail + Priority Handling – Delivery usually by third working day

Rest of World

  • Airmail + Priority Handling – Delivery usually by fifth working day

All orders are dispatched from the UK. Any additional charges for customs clearance into other countries must be borne by you (see paragraph 10 above – Customs).

We ship to most international destinations and will notify you if we are unable to ship to a particular destination.

26.    Currency Conversion

You can choose to display another currency for comparison - just click on any price on any product’s full description page or on any price on the Shopping Cart page and you can then convert the value to either Euros, US Dollars or Australian Dollars.

Please note that the currency converter is for information only and the transaction will be completed in GBP (£ pound sterling) and if appropriate converted by your bank at their prevailing exchange rate.

27.    Payment Methods

For your convenience and security Pants People uses PayPal for all its payment processing. You can pay for products either by using your credit card online or by using your PayPal account. For more information on PayPal please visit www.paypal.co.uk

We currently accept the following credit and debit cards online:

  • MasterCard / Eurocard
  • PayPal Top Up Card
  • Maestro
  • Solo
  • American Express

Debit cards (also known as bank cards) are accepted if they have a Visa or MasterCard logo.

Unfortunately we are unable to accept payment by cheque or bank transfer or any method other than those listed above.

Your card is only charged when your items are ready to be dispatched.
